The Privacy Policy pertains to the services (including all services and software applications this Privacy Policy is applicable to, hereinafter referred to as "Services") managed by Yaply’s Developer and its affiliates (collectively referred to as “we”,“us” or “our”).
This Privacy Policy elucidates what Personal Information (defined below) we gather, the manner in which we utilize and share that information, and the choices you have regarding our data practices. This Privacy Policy is integrated into and forms part of our Terms of Service.
Please carefully review this Privacy Policy before utilizing the Services or submitting any Personal Information to Yaply. Your agreement to the practices described in this Privacy Policy is implied by your use of the Services. If you disagree with this Privacy Policy, you are advised not to access any of our Websites or use the Service in any way.
Undefined capitalized terms used herein shall have the meaning set forth in the Yaply Terms of Service.
1.INFORMATION WE COLLECT
1.1 Information you provide
We may obtain information directly from you in various ways. For instance, you might share information with us when using our Services, contacting us, or subscribing to our newsletters. The information you provide may relate to yourself or others and may include, but is not limited to:
● Your User Content (as defined in the Terms of Service), such as chat messages, uploaded images, and shared Characters;
● The content of your communications with us.
1.2 Information we Collect Automatically
(a)We and our third-party vendors may use cookies, web beacons, and other tracking technologies to collect information about the computers or devices (including mobile devices) you use to access the Services. As described further below, we may collect and analyze information including but not limited to (i) browser type; (ii) ISP or operating system; (iii) domain name; (iv) access time; (v) IP address; (vi) unique device identifiers (e.g. IDFA or Android ID); (vii) version of our Services you’re using; and (viii) the type of device that you use. We may also track when and how frequently you access or use the Services, including how you engage with or navigate our site or mobile application.
We may use this information (including the information collected by our third-party vendors) for analytics (including to determine which portions of the Services are used most frequently and what our users like/do not like), to evaluate the success of any advertising campaigns, and as otherwise described in this Policy.
(c)We and our third-party vendors may use cookies, clear GIFs, pixel tags, and other technologies that help us better understand user behavior, personalize preferences, perform research and analytics, and improve the Services. These technologies, for example, may allow us to tailor the Services to your needs, save your password in password-protected areas, track the pages you visit, help us manage content, and compile statistics about usage of our Services. We or our third-party vendors also may use certain of these technologies in emails to our customers to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.
(d)When you use the Services, we may collect general location information (such as general location inferred from an IP address).
1.3 Information we collect from other sources.
We may also collect information about you from other parties, such as when you are referred to us by another user. We may also receive information about you from third party social platforms, such as Facebook or Instagram, when you interact with our social media profiles.

3.HOW WE SHARE YOUR INFORMATION

We may discose your information to employees, consultants, and other vendors who need access to such information to carry out work or perform services on our behalf, such as those who provide data storage, payment, technology support and services, customer service, analytics, fraud prevention, legal services, and marketing services.
(b)Affiliates. We may disclose information to our affiliates, meaning an entity that controls, is controlled by, or is under common control with Yaply. Our affiliates may use the information we disclose in a manner consistent with this Policy.
(c)Safety and Protection of Yaply and Others. We may disclose certain information if we believe in good faith that doing so is necessary or appropriate to (i) protect or defend the Yaply or other parties, including to defend or enforce this Policy, our Terms of Service, or any other contractual arrangement; and/or (ii) protect the rights, property or personal safety of Yaply, our agents and affiliates, our employees, users and/or the public.
(d)Advertising and Analytics. Though we do not engage in advertising as of the date of this Policy, we may in the future disclose or make available some of your information with advertising and analytics partners to serve advertisements on our behalf across the internet and to provide analytics services. These entities may use cookies and tracking technologies to allow us to, among other things, track and analyze data, determine the popularity of certain content, deliver advertising and content targeted to your interests and better understand your online activity.
(e)Legal Requirements. We may disclose certain information if we believe in good faith that doing so is necessary or appropriate to comply with any law enforcement, legal, or regulatory process, such as to respond to a warrant, subpoena, court order, or other applicable laws and regulations.
(f)Where we reasonably believe that someone's life is at risk. For example, if we become aware of a person threatening to commit suicide, we may share that person's data with appropriate entities that may have the ability to help.
(g)In situations involving legal claims against us or one of our users. If you challenge such a notice, we may share your response with the complainant.
(h)Business Transfers. We may disclose certain information, in connection with or during negotiations or closing of any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
(i)Your User Content. Certain actions you take may be visible to other users of the Services or result in content that is made available to other users of the Services.
(j)Other disclosures with consent or at your direction. We may disclose your information to nonaffiliated third parties based on your consent to do so. For example, you may direct us to disclose information about you when you refer us or our Services to your friends or other acquaintances.
4.TRANSFER OF PERSONAL DATA
Your personal information may be stored on servers located in, and may be accessed by Yaply’s employees and contractors located in one or more countries outside of the country in which you reside. And by using an Application or the Services you consent to the transfer of your Information to countries, which may be outside of your country of residence and may provide for different and less stringent data protection rules than in your country. If you object to your Information being transferred or used as described in this Policy, please do not use any Application and immediately delete all Applications from your User Devices.
5.HOW WE SECURE YOUR INFORMATION
5.1 We employ proper technical and physical measures to protect the personal data of our users from loss, destruction, change, unauthorized access, disclosure, or any other illegal forms of processing.
5.2 We employ a modern means of protection for the personal data of all users according to the current state of the industry. This includes, for example, firewalls, password protection and other access and authentication controls.
5.3 Limited access to personal data by Yaply staff on a need-to-know basis, and the use of robust authentication processes (e.g. complex passwords or two-factor authentication).
5.4 The use of data centers with effective physical and logical data security controls, and the use of reputable third parties who have demonstrated security consciousness; and secure office premises and staff that are keenly aware of their data protection responsibilities.
5.5 However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. We cannot ensure or warrant the security of any information you transmit to us or store on our service, and you do so at your own risk. We also cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.
6.YOUR CHOICES
To the extent required by the law of your jurisdiction, you may have one or more of the below rights. You can exercise any of the below rights by submitting a support form, by emailing cesaretcapucine@gmail.com.
6.1 The right to be informed. The User has the right to be provided with clear, transparent and easily understandable information about how Yaply collects and uses personal data and its rights. This is the reason why Yaply is providing the User with the information in this privacy policy.
6.2 The right of access. The User has the right to obtain access to its personal data (if Yaply is processing it), and other certain information (similar to that provided in this privacy policy). You may request certain information about our disclosure of personal information to third parties for their own direct marketing purposes during the preceding calendar year. This request is free and may be made once a year.
6.3 The right to rectification. The User is entitled to have its personal data corrected if it’s inaccurate or incomplete.
6.4 The right to erasure or deletion. This right to be forgotten enables the User to request the deletion or removal of its personal data where there’s no compelling reason for Yaply to keep using it. This is not a general right to erasure; there are exceptions.
6.5 The right to restrict processing. Under certain circumstances, the User has the rights to ‘block’ or suppress further use of its personal data.
6.6 The right to opt out of the sale of your personal information. The user has the right to ‘opt out’ from the sale of their personal information to a third party.
6.7 The right to data portability. The User has the right to receive their personal data maintained by Yaply in a structured, commonly used and machine readable format and has the right to transmit that data to another controller.
6.8 The right to object to processing. The User has the right to object, on grounds relating to its particular situation, at any time, to the processing of its personal data.
6.9 The right to lodge a complaint. The User has the right to lodge a complaint about the way Yaply handles or processes its personal data with its national supervisory authority.
6.10 The right to withdraw consent. If the user has given its consent for a specific processing of its personal data implemented by Yaply, the User has the right to withdraw its consent at any time. In case the User does so, it does not mean that anything Yaply has done with the User’s personal data with its consent up to that point is unlawful but Yaply will not use the user’s personal data for that purpose in the future.
6.11 The right to define instructions. The User has the right to define general or specific instructions regarding storage, deletion and use of its personal data after death.
7.DATA RETENTION
We will retain your personal information for only as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.
To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.
8.CHILDREN’S PRIVACY
8.1 Yaply is not directed to children, and if you are under the minimum age as specified in Yaply Terms of Use Agreement, you may not create a Yaply account or use Yaply services,should not provide any personal data to the App.
8.2 Yaply has zero tolerance to any form of child abuse or exploitation. Your data (including group messages and private messages) may be shared with law enforcement agencies if we have reasonable grounds to believe that you have engaged in child pornography, or if we are requested to do so by law enforcement agencies.
9.CHANGES TO THIS POLICY
9.1 Yaply periodically makes changes to the privacy policy. The terms of this Privacy Policy may change from time to time without prior notice to you, so please check our Privacy Policy periodically for any changes.
9.2 Any material change to this Privacy Policy will be displayed on our App. Personal data collected by us will be dealt with in accordance with the provisions of our Privacy Policy which were in effect at the time of collection. Your continued use of our Services following the posting of any changes to this Privacy Policy means you accept such changes.
